What is the Law in Maryland?

> .08 - Driving Under the Influence (DUI)

> .07 < .08 - Driving While Impaired (DWI)

> .05 < .07 - There will be no presumption that the Defendant was or was not under the influence or impaired, but the results may be considered with other evidence in determining guilt or innocence.

< .05 - It is presumed that the person was not under the influence and was not driving while impaired.

.02 - remains the legal limit for under 21.  However, it is good to remember that Maryland is a "Zero Tolerance" State and if you drive with any alcohol in your system, you will lose your driver's license for at least 6 months.

Penalties:

DUI - 1st conviction:     Up to 1 year in jail and/or up to $1000.00 fine

        2nd conviction:     Up to 2 years in jail and/or up to $2000.00 fine

        3rd conviction:      Up to 3 years in jail and/or up to $3000.00 fine

DUI and transporting a minor - 1st conviction:  Up to 2 years in jail and/or up to $2000.00 fine

                                                 2nd conviction:  Up to 3 years in jail and/or up to $3000 fine

                                                 3rd conviction:   Up to 4 years in jail and/or up to $4000 fine
